You can go to small claims court if they had tried unsuccessfully to get compensation for damages through other means. If negotiations have not worked, mediation has not been an option, and arbitration is not practical for some reason, small claims court offers you another option.

Court of Claims smaller has its advantages: it is easy for almost anyone to handle, you do not need a lawyer to defend the case for you, and you need not know much about protocols of the court or how to impress a jury. Then the defendant will present his version history. After that, the judge makes a decision. It's that simple. Small Claims Court has its drawbacks though. More limiting is that there are limits imposed by the state awards more courts. For example, most states do not allow suing for over $ 1500 in small claims court. Other states can go as high as $ 15,000.
